2. OUR ROLE: DATA CONTROLLER VS. DATA PROCESSOR
It is important to distinguish between the roles we play in relation to your data:
Data Controller: When you become a customer, visit our website or contact us, we process your data. This privacy statement covers this.
Data Processor: If you send email marketing campaigns or upload contact lists via ‘De Tool’, we process personal data on your behalf. You remain in control of that data. We have set out the arrangements for this
set out in our Standard Data Processing Agreement (DPA).
3. WHAT PERSONAL DATA DO WE PROCESS?
We process personal databecause you use our services (such as WaaS, DaaS, or De Tool) and/or because you provide this data to us yourself. We process the following data:
Name and address details: First name and surname, address, postcode, town/city.
Contact details: Email address and telephone number.
Company details: Company name, Chamber of Commerce number, VAT number and job title.
Financial details: Bank account number (IBAN) and payment details for invoicing and direct debit.
Account and technical data: Login details for De Tool, IP address, web browser, device type and your activity on our website or within our platform.
Communication: Data you share in emails, support tickets, via WhatsApp (for example, for our CaaS service) or during telephone calls with our marketing team.
4. WHY DO WE PROCESS THIS DATA?
We process your data exclusively for the following purposes, based on a legal basis under the GDPR:
Performance of the Contract: To deliver, host and maintain the subscriptions you have chosen (such as WaaS, DaaS or De Tool). To process payments. To provide support and carry out monthly tasks (design, web management, etc.).
Legal Obligation: To comply with our record-keeping and retention obligations towards the tax authorities (such as retaining invoices).
Legitimate interest: To optimise and secure our website, the functioning of De Tool and our services. To inform you (as an existing customer) about changes to our services or relevant new features within the ecosystem.
Consent: To send newsletters if you are not (yet) a customer, or to place tracking cookies. You may withdraw this consent at any time.
5. HOW LONG DO WE RETAIN YOUR DATA?
We do not retainpersonal data for longer than is strictly necessary to fulfil the purposes for which the data is collected.
Customer data and accounts: Up to 2 years after you have terminated your subscription (WaaS, DaaS, The Tool) with us.
Financial data (invoices): 7 years, in accordance with the Tax and Customs Administration’s statutory retention obligation.
Communication (support/WhatsApp): Up to a maximum of 2 years after the project or enquiry has been resolved.
6. SHARING DATA WITH THIRD PARTIES
We do not sell your data to third parties. We only disclose this data if it is necessary for the performance of our agreement with you (such as engaging external infrastructure and data centre providers for our managed hosting) or to comply with a legal obligation. We enter into a data processing agreement with external parties that process your data on our behalf (so-called sub-processors) to ensure the same level of security and confidentiality. We guarantee that data is stored within the European Union (EEA) as far as possible.
7. SECURITY OF YOUR DATA
We take the protection of your data seriously. Usere takes appropriate technical and organisational measures to prevent misuse, loss, unauthorised access, unauthorised disclosure and unauthorised alteration. We use secure connections (SSL) and encrypted passwords, and our servers are strictly secured.
If you feel that your data is not properly secured or there are indications of misuse, please contact us immediately at usere.
8. YOUR RIGHTS
You have the right to remain in control of your own data. This means you have the following rights:
